1. ACCEPTANCE OF TERMS


These Terms of Service ("Terms") constitute a legally binding agreement between you and Careersy AI Pty Ltd (ABN 55 143 766 707) ("Careersy," "Company," "we," "us," or "our"), governing your access to and use of the Careersy AI platform, website, web application, APIs, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years of age to use the Service.

2. SERVICE DESCRIPTION


Careersy AI is an AI-powered career mentoring platform purpose-built for senior technology professionals in Australia and New Zealand. The Service leverages large-language-model technology (currently powered by Anthropic) to deliver:

  • AI-guided career conversations and strategic mentoring
  • Resume / CV review, optimisation, and rewriting assistance
  • LinkedIn profile analysis and enhancement guidance
  • Job-search strategy recommendations tailored to the ANZ market
  • Interview preparation and coaching resources
  • Career positioning and personal-brand advice
  • Subscription-based access to premium features and tools

The specific features, AI models, and third-party providers used by the Service may change over time as we improve the platform.

3. ACCOUNT REGISTRATION AND RESPONSIBILITIES


3.1 Accurate Information

To access the Service you must create an account and provide accurate, current, and complete information. You agree to update your information promptly if it changes.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@careersy.ai if you suspect unauthorised access. We are not liable for losses resulting from your failure to secure your account.

3.3 One Account per Person

Each individual may maintain only one active account. Creating multiple accounts to circumvent usage limits, exploit promotional offers, or for any other reason is prohibited and may result in immediate termination.

3.4 Account Sharing

Accounts are personal and non-transferable. You may not share your account credentials with any third party. We reserve the right to suspend accounts where concurrent or anomalous usage patterns indicate sharing.

4. PAYMENT TERMS AND BILLING


4.1 Subscription Plans

Careersy AI offers subscription plans as described on our Pricing page. All prices are stated in Australian Dollars (AUD) and are inclusive of GST where applicable.

4.2 Recurring Billing

By subscribing you authorise us to charge your nominated payment method on a recurring basis (monthly or annually, depending on your chosen plan) until you cancel. Payments are processed securely through Stripe; we do not store full card details.

4.3 Founding Member Pricing

Users who subscribe during our founding-member launch period receive a discounted rate that is locked in for the lifetime of their continuous subscription. If you cancel and later re-subscribe, standard pricing at the time of re-subscription will apply.

4.4 Free Access and Upgrading

We do not collect your payment details up front. You can use the Service's limited free allowance without entering any card information. To continue beyond that allowance, you choose a paid plan and complete payment through Stripe at that point. Recurring billing begins only when you actively subscribe, and no free usage ever converts to a paid plan automatically.

4.5 Refunds

Refunds are available within 7 days of your initial subscription purchase, provided you have not exceeded 10 AI interactions during that period. After 7 days, or once 10 interactions have been used, subscriptions are non-refundable for the remainder of the billing cycle.

4.6 Price Changes

We reserve the right to adjust pricing for new subscribers with at least 30 days' notice. Existing subscribers will be given at least one full billing cycle of notice before any price increase takes effect, unless a locked founding-member rate applies.

4.7 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any similar applicable state or territory legislation that cannot be excluded, restricted, or modified by agreement.

5. INTELLECTUAL PROPERTY


5.1 Our IP

The Service and its original content, features, functionality, branding, and underlying technology are and remain the exclusive property of Careersy AI and its licensors, protected by copyright, trademark, trade-secret, and other intellectual property laws. Our trademarks and trade dress may not be used without prior written consent.

5.2 Your Content

You retain all ownership rights in the content you submit to the Service (resumes, cover letters, career history, etc.). By submitting content you grant Careersy AI a limited, non-exclusive, royalty-free licence to process, store, and display that content solely for the purpose of providing and improving the Service to you.

5.3 AI-Generated Output

Output generated by the AI in response to your inputs ("AI Output") is provided for your personal use. You may use AI Output in your career materials. However, AI Output may not be unique to you and we do not claim or assign copyright in AI Output. You are responsible for reviewing and adapting any AI Output before relying on it.

5.4 Feedback

If you provide suggestions, ideas, or other feedback about the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free licence to use that Feedback for any purpose without obligation to you.

6. USER CONDUCT


6.1 Prohibited Activities

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right
  • Impersonate any person or entity or misrepresent your affiliation
  • Submit false, misleading, or fraudulent information
  • Upload or transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorised access to the Service, other accounts, or related systems
  • Use automated bots, scrapers, or crawlers to extract data from the Service
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Reproduce, distribute, or create derivative works from Service content without permission
  • Interfere with or disrupt the integrity or performance of the Service

6.2 Content Standards

You must not submit content that is unlawful, defamatory, obscene, harassing, or otherwise objectionable. We reserve the right to remove content that violates these standards and to suspend or terminate accounts responsible.

6.3 Fair Use

Usage limits may apply to prevent abuse. Excessive automated or programmatic use beyond normal human interaction is prohibited. We reserve the right to throttle or suspend access where we reasonably believe abuse is occurring.

7. PRIVACY AND DATA


7.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, disclose, and safeguard your information. By using the Service you consent to the practices described therein.

7.2 AI Data Processing

Conversations and documents you submit are sent to third-party AI providers (currently Anthropic) via their API for processing. We use enterprise/API access, meaning your data is not used to train those providers' public models. Refer to our Privacy Policy for full details.

7.3 Data Retention

We retain your data for as long as your account is active and as needed to provide the Service. You may request deletion of your data at any time by contacting support@careersy.ai. Upon account deletion, personal data will be removed within 30 days except where retention is required by law.

7.4 Data Location

Data is primarily stored and processed in Australia and the United States. By using the Service you consent to the transfer and processing of your data in these jurisdictions, subject to appropriate safeguards.

7.5 Australian Privacy Principles

We comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). You have rights of access and correction under the APPs, and may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe we have breached the APPs.

7.6 New Zealand Users

If you are based in New Zealand, the Privacy Act 2020 (NZ) also applies to the handling of your personal information. You have the right to access and request correction of your personal information under the NZ Information Privacy Principles.

8. DISCLAIMERS AND LIMITATIONS


8.1 No Guarantee of Outcomes

Careersy AI provides AI-generated career guidance based on patterns, best practices, and ANZ market knowledge. The Service does not guarantee any specific outcome, including employment, interviews, salary increases, promotions, or career advancement.

8.2 Not Professional Advice

AI Output is for informational and guidance purposes only and should not be construed as professional legal, financial, tax, immigration, or human-resources advice. You should exercise independent judgment and, where appropriate, seek qualified professional advice before acting on any recommendation.

8.3 Service Availability

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

8.4 Limitation of Liability

To the maximum extent permitted by applicable law, Careersy AI and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total aggregate liability for any claim shall not exceed the total fees you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

8.5 ACL Savings Clause

Where the Australian Consumer Law or any other legislation implies warranties or conditions that cannot be excluded, our liability for breach of such warranty or condition is limited, at our option, to the resupply of the services or the payment of the cost of having the services resupplied.

9. INDEMNIFICATION


You agree to indemnify, defend, and hold harmless Careersy AI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.

10. TERMINATION


10.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings or by contacting support@careersy.ai. Cancellation takes effect at the end of the current billing period; you will retain access until then.

10.2 Termination by Us

We may suspend or terminate your account immediately and without prior notice if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or if required by law. We may also terminate accounts that have been inactive for an extended period with prior notice.

10.3 Effect of Termination

Upon termination: (a) your right to use the Service ceases immediately; (b) we may delete your data in accordance with our Privacy Policy; (c) any outstanding fees remain payable; and (d) provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will continue in full force.

11. DISPUTE RESOLUTION


11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict-of-law provisions.

11.2 Informal Resolution

Before initiating formal proceedings, you agree to first contact us at support@careersy.ai and attempt to resolve the dispute informally for at least 30 days.

11.3 Jurisdiction

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in this clause limits your right to bring proceedings in any court of competent jurisdiction where required by applicable consumer protection law.

11.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.

12. CHANGES TO TERMS


We reserve the right to modify these Terms at any time. Material changes will be notified via email to your registered address and/or by a prominent notice within the Service at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription.

13. GENERAL


13.1 Entire Agreement

These Terms, together with the Privacy Policy and any plan-specific terms presented at checkout, constitute the entire agreement between you and Careersy AI regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Careersy AI.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

13.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, pandemics, or third-party service provider failures.
